A note regarding Ohio auto titles!!

One of the most commonly notarized documents, it is also often completed incorrectly, resulting in having to obtain a duplicate title. Important points to remember when requesting notarization
of a title:

DO NOT FILL IN ANY OF THE SPACES OR SIGN THE TITLE UNTIL THE NOTARY IS PRESENT!!

The Assignment of Title and Application for Ownership sections are BOTH sworn statements by the signers that the title information is truthful and correct. The seller does not need to be present when the seller signs the car over, but the seller MUST know the name and address of the buyer, must be sworn in, and must sign in the presence of the notary after providing proper ID. The title cannot be notarized with any blank spaces.

The seller cannot just "sign over" the title to the seller, and have the signature notarized later. Again, the seller MUST appear and sign in front of the notary. This is the reason that notaries are required by the state for this process - to prevent fraud. The only exception to this is if the signer has executed a Power of Attorney form permitting a third party to sign for him/her. This form ia available at any BMV office or the BMV website, and must also be notarized.

After receiving the title, the buyer must also have his signature notarized in order to apply for a new title. Call if you have any questions about this process.
What is a Notary Public?

In Ohio, a Notary Public is a public officer appointed under state law with power to administer oaths, certify affidavits,
take acknowledgements, and otherwise act as an impartial witness. In most counties, an examination must be passed demonstrating knowledge of the various rules, laws, statutes
and duties of the office. A Notary Public is a guardian of the public trust, and must perform his/her duties with absolute integrity and observing the highest ethical standards. Ohio notaries are commissioned through the Secretary of State.

The title and office of Notary Public is an ancient and honorable one, demanding knowledge of and strict compliance with the law. It dates back over two thousand years to the days of the Roman Empire, when a notary might have neen compensated for their services with salt! Notaries serve in every state and territory in the Union, and in nearly every country of the world.

It is important to note that a commission as a Notary Public is NOT to be confused with a license to practice law, and in fact a notary is specifically prohibited from practicing law unless the notary is also an attorney.

The primary duty of every Notary Public is to deter fraud. As a commissioned Officer of the State, the Notary has a duty to ensure all elements of a proper notarization are met:

Identification of any persons affixing their signature to a document requiring a notarial act.

The signer(s) is aware of the content of the document

The signer(s) is executing the document freely and without duress or coercion

The date and venue of the signing are correct. in the notarization. Backdating of a notarization is illegal.
